Adjuster Classification Definitions
- Independent Adjuster:
a person licensed as an all-lines adjuster who is self-appointed or appointed and employed by an independent adjusting firm or other independent adjuster, and who undertakes on behalf of an insurer to ascertain and determine the amount of any claim, loss, or damage payable under an insurance contract or undertakes to effect settlement of such claim, loss, or damage.
- Company Adjuster:
a person licensed as an all-lines adjuster who is appointed and employed on an insurer’s staff of adjusters or a wholly owned subsidiary of the insurer, and who undertakes on behalf of such insurer or other insurers under common control or ownership to ascertain and determine the amount of any claim, loss, or damage payable under a contract of insurance, or undertakes to effect settlement of such claim, loss, or damage.
- Emergency Adjuster:
a person who is not a licensed adjuster under this part, but who has been designated and certified to the department by insurers as qualified to adjust claims, losses, or damages under policies or contracts of insurance issued by such insurer, and whom the department may license, in the event of a catastrophe or emergency, for the purposes and under the conditions which the department shall fix and for the period of the emergency as the department shall determine, to adjust claims, losses, or damages under the policies of insurance issued by the insurers.
1. Public Trust and Fair Treatment
- All adjusters must put the fair and honest treatment of the claimant above their own interests and the interests of the firm.
- Claimants shall never be discouraged from seeking legal advice or public adjuster representation.
- No adjuster shall provide favored treatment to any party or settle a claim in a way that is prejudicial to the insured.
2. Integrity in Investigation and Reporting
- All investigations, estimates, and settlements must be based on full, complete, and truthful assessments of the facts.
- Adjusters shall never make false, misleading, or incomplete statements, and must act with promptness and diligence in the claim process.
- Adjusters must be competent and knowledgeable about the terms and conditions of all relevant insurance policies.
3. Prohibited Conduct
- No adjuster may steer a claimant toward any contractor, vendor, or service provider in which they have an undisclosed financial interest or from which they expect compensation.
- Adjusters shall not negotiate or obtain statements from claimants or witnesses who are in a state of trauma or emotional distress.
- Adjusters may not engage in any claim activity if their license is revoked or suspended, and no unlicensed individual may perform claim services on behalf of the firm.
4. Conflict of Interest Restrictions
- No person acting as an independent or company adjuster shall represent G&G Insurance Adjusters, Inc. against any person or entity they previously represented as a public adjuster.
- All potential conflicts of interest must be disclosed immediately and managed in accordance with ethical and legal guidelines.
5. Estimate and Documentation Standards
- All residential property estimates must be prepared using an approved electronic estimating platform, and shall reflect accurate per-unit pricing relevant to the geographic market.
- Any modification to an estimate must include:
- – A written variation report or explanation for changes;
- – Documentation supporting the modification;
- – The adjuster’s name on the modification record.
- Adjusters are prohibited from arbitrarily altering prices unless documentation justifies the change based on current market conditions.
6. Advertising and Identification
- All advertisements, solicitations, and communications must clearly identify the type of adjuster license held by the individual (e.g., Independent, Company, or Emergency Adjuster).
7. Accountability
- We handle every claim with honesty, integrity, and transparency—allowing a fair settlement to all parties without seeking unauthorized compensation or gain.
- Adjusters must provide all required estimates and documentation to insureds within statutory time frames.
- We maintain internal accountability by requiring all adjusters to comply with both state regulations and G&G’s internal standards of practice.
G&G Insurance Adjusters, Inc. holds its professionals to the highest standards of ethical conduct. By doing so, we ensure confidence from the public, our clients, and the insurance industry as a whole.
